Sealed tenders are invited for supply of medicines on daily/monthly basis to the
Indian Red Cross Society, U.T. Branch, Chandigarh for the year 2009-10.
The Tenderer for medicines must have a valid Drug/Medicine Sale
The Tenderers must have a minimum of three year experience in the
field and their annual turnover for 3 years i.e. 2006-07, 2007-08 and
2008-09 must not be less than Rs. 30 lacs.
The Tender details, “Terms and Conditions” may be had from the office
of the Secretary, Indian Red Cross Society, U.T. Chandigarh, Karuna
Sadan Building (2nd Floor), Sector 11-B, Chandigarh on payment of fee
The tender must reach this office in a sealed cover superscribed as
“Tender for supply of medicines-2009-10” latest by 18-06-2009 at 5.00
P.M. and the same shall be opened on 19-06-2009 at 10:00 A.M. in the
presence of those parties who wish to be present.
Tenders received beyond this date and time will not be accepted.

Only Chemists/Dealers holding a valid Drug/Medicine sale license whose average annual turn over for 3 years i.e. 2006-07, 2007-08 and 2008-09 is more than Rs. 30 Lacs are eligible to participate in the tender for medicines.
The tenderer will quote the rates of medicines as mentioned in the annexure (s) appended herewith, alongwith rebate in percentage term offered on Generic and Non-Generic medicines included in the list and otherwise required on day to day basis as per prescription of the Doctor(s). In case of Generic Medicine tenderer should ensure that only GMP certified Company’s Medicines are being supplied.
The rates should be quoted in whole rupee and paisa only and must be expressed in figures and in words (English) alongwith the rebate offered on MRP.
The tender must be accompanied by earnest money of Rs. 10,000 in the shape of Bank Draft/Pay Order of any Scheduled Bank drawn in favour of Secretary Indian Red Cross Society, U.T. Chandigarh.
The amount of earnest money shall not be accepted through cheque. The amount of earnest money, if any, lying with the society or any other pending amount will not be adjusted against the present tender. The earnest money of the successful Tenderer(s) shall be converted into Performance Security and shall be refunded without interest after the faithful execution/completion of the contract.
5. Conditional/telegraphic tender/tender received through fax, tenders without earnest
money and submitted not on the prescribed form shall not be entertained.
6. Tender should only be signed by the authorized signatory alongwith the seal of the
firm. Tenderer is free to quote rates for any or all the items. Correction/overwriting If any, should be authenticated under the signature of the tenderer. However, the Society reserves the right to place the order in parts or as a whole to the one or more tenderers.
7. The validity of tender shall be for 60 days from the date of receipt. The finally
approved and determined rates will remain in force for one year from the date of award of contract with a provision to extend by further period of three months at the same rates approved b the Society. The Society will not entertain any request for the increase of rates on account of increase of tax, excise duty, natural calamity, strike, other levies or any other reasons, whatsoever, during the period of contract. 8. The Central sales Tax/VAT/Service Tax, if applicable, should be indicated clearly in the tender form as “Central Sales Tax/VAT/Service Tax Extra” alongwith the percentage of Central Sales Tax/VAT/Service Tax as applicable against each and every item failing which it will be treated that the rates quoted by the tenderer are inclusive of Sales Tax/Central Sales Tax/VAT/Service Tax. After this no representation/ request regarding payment of Central Sales Tax/VAT/Service Tax shall be entertained.
9. The rates quoted should be F.O.R. Store of the Society or any other destinations in
Chandigarh as fixed by the Society irrespective of quantity ordered.
10. The Society reserves the right to reject the supply of medicines for which the contract is
awarded, if it is not found as per prescription, wholly or partly, and the rejected quantity shall be lifted/removed by the supplier immediately from the premises/other units of the Society at their own expenses on being informed of the same. In case the tenderer fails to remove the rejected medicines, the Society reserves the right to dispose off the same at the cost of the tenderer and no claim whatsoever shall be entertained.
11. Damages and breakages if any found in transit, the articles thereof, should be replaced.
Otherwise the cost will be deducted from the bill.
12. The Society shall not be in any manner concerned with the internal affairs of the
tenderers i.e. dispute and dissolution, etc. or affairs concerning any other (third) part that the supplier may be having.
13. The medicines should only be supplied against the requisition signed by the Joint
Secretary/Secretary, Indian Red Cross Society U.T. Branch, Chandigarh.
14. The tenderer will collect requisition and arrange to supply the medicines daily in the
premises of the society or other units as may be fixed by this Society.
15. The quality for medicines supplied to the patients must be maintained. In case of a
complaint from the users/patients regarding quality of medicines or by physicians treating the patients at PGI, GMSH, Sector 16 and GMCH, Sector 32, Chandigarh or Incharge Health Care Centre, Medical Officer, Chandigarh Hospice, Sector 43, Chandigarh and Community Care Centre, Khuda Alisher, Chandigarh, the contract for supply of medicines is liable to be terminated.
16. This contract is liable to be canceled in case of change or substitution made in the
supply of medicines as prescribed by the Doctor without any prior intimation and approval.
17. Indian Red Cross Society U.T., Branch, Chandigarh shall be free to make purchase of
medicines/surgical items from a supplier other than the tenderer in event of his inability to provide or provide in time or in case of variation of rates.
18. The tenderer will submit the bills in duplicate on the same day alongwith the medicines
supplied in the name of Secretary, Indian Red Cross Society U.T. Branch, Chandigarh quoting the following details;
Details of medicines supplied i.e. Qty. issued, MRP.
Rebate given on Generic and Non-Generic medicines separately.
The price and rates should be typed clearly and legibly without any erasure or overwriting.
19. The category of Medicines (i.e. Generic or Non-Generic) should be indicated against
each medicines supplied to Indian Red Cross Society U.T. Branch Chandigarh.
20. In case of non-supply of medicines on the same day for more than 5 times, or short
supply/poor quality supply/late supply to the Society, the contract can be liable to be considered for cancellation, forfeiture of security and blacklisting of the tenderer’s firm upto the period of 3 years.
21. The Society shall be at liberty to purchase/medicines from Govt. approved agencies and
the tenderer shall have no objection to it.
22. The Tenderer shall be duty bound to effect the supply of medicines during the Contract
23. Failure to discharge the contractual obligations by the tenderer will lead to blacklisting
of the firm for future supplies/tendering in the Society upto three years and the security deposited shall be forfeited.
24. Payment will be processed on fortnightly basis i.e. in batches of 1st to 15th and 16th to
30th /31st of each month. Payment of each batch will be released within 15 days of close of each batch. Thus, while payment of bills from 1st to 15th of a month will be made upto 30th of the same month, payment for bills in the batch of 16th to 30th/31st will be released before 15th day of next month.
25. The free scheme, if any introduced by the Manufacturer/Authorized Distributors with
the sale of product form time to time shall also be applicable to the Society. In such cases the tenderer shall indicate the details of free supply in the bill, while supplying the indented material.
26. The contract, if awarded, for specific period, can be terminated at any time without
assigning any reason, whatsoever, even before the expiry of the contract period.

the same shall be referred for arbitration to the Chairman Indian Red Cross Society or any person appointed by him/her. The award of the Arbitrator shall be final and binding on both the parties.
I/We undertake to supply the indented medicines/surgical items to the Society strictly as per the specifications, indents and schedule of supply timings. I/We will execute the contract truly and faithfully as set forth in the terms and conditions of contract letter. I/We shall be responsible for all the complaints as regards the quality/specifications, etc.
